Rear ended by unlincensed driver, insurance refuses to pay?

Hi all, I was hoping that I could get some guidance as to how I should proceed with this. Thank you in advance. The accident occurred 7 days ago in CA. I was driving home from work in the 4th lane of a 4 lane highway. There was a gap of approximately 4~5 cars in the 3rd lane, so I switched into that lane. By the time I finished the lane change, there was approximately 3~4 cars distance between me and the car behind me. I then drove for approximately a 100 yards, at which point the traffic suddenly slowed and I decelerated. The guy behind me, however, seems to have been looking elsewhere and rear ended me. However, before he collided, he managed to swerve his car and hit the corner of my rear bumper with the corner of his front bumper. We pulled over to the side of the road and exchanged information. It turns out that he does not have a driver's license (or any California/U.S. ID; he showed me a Mexican ID). He begged me not to call the police, admitted fault and said that he would settle it through his insurance (he is insured with a VERY shady place called Access General). I took pity on him, especially since it was very likely that he is an illegal immigrant, so I just took his information down and moved along. Fast forward a few days, and I find out that he has told his insurance that I cut in front of him and that he is not at fault. Since there are no witnesses or a police report, his insurance takes his side. Meanwhile, since I only have liability with Geico, they are saying that they can't help me. The damage to my car is between $4~5k, and that is not even taking into account devaluation of the car's value. I feel very cheated because I took pity on him and I am rewarded with a repair bill that nobody wants to deal with. I have called him multiple times and asked him to tell the truth, but he just ignores me. I am now very angry and want to do 2 things: 1. Get my car repaired. 2. Screw up his life. Hopefully get him deported (very strong liklihood of him being an illegal immigrant), or at the least bankrupt him. I took pity on him because he was in a time of need. All he had to do was tell the truth to his insurance, but he was afraid that his monthly bill would go up... so he lies and screws me instead. Do you have any recommendations for lawyers who would be willing to take on property damage lawsuits? What are my options?

Basically i passed my test in may and it is my 19th in 2 weeks, my mum just bought a car for my birthday which is in perfect running order and good condition as it was owned my an old bloke. I'm very frustrated at this point. Two years ago I got braces, at the time I was still living on the east coast. I then moved to California halfway during treatment and learned that my insurance was not going to cover treatment after my transfer (even under their providers). i have just passed my driving test & was looking at insurance quotes on different comparison websites . i am a 36 year old man with 4 kids & wife & need to get a car to further my career . i got a quote for a 1997 R reg 800cc Daewoo matiz and will be fitting an alarm as well as keeping it locked in my garage overnight but the cheapest quote a can find is 1282 a year fully comp & paying up front .I also got a quote for a 1998 S reg 1.4 Peaugeot 306 Meridian & the quote I received for this car was 942 for the year again payment upfront . the problem I have is that with the latter quote for the Peaugeot is that there wasn't any alarm on the quote & it was to be parked in the carpark next to my house . My friends got an 02 Acura RSX 5 speed and he pays like $600/month and the car has some engine mods. We are both 17 except he has a couple tickets. I called 3 different insurance companies and they all quoted me around $750 a month. the car in question was a 76 Chevrolet Camaro with an automatic trans and 350ci v8 (though the vin would probably indicate a 267ci v8) why is the newer car cheaper to insure? with a manual trans? kids these days dont appreciate the old cars like I do and stick with Honda and Acuras and those are the ones I actually see getting wrecked. I wouldn't get full coverage on the old car because if it were to wreck i'd just get another as they aren't worth fixing and are a dime a dozen it's not really a rare classic car. I understand that engine size might be a factor. The rsx is lighter and has a smaller engine but the Camaro is much heavier with a bigger engine. Would a z28 cost more? (already upgraded to 350 and upgraded suspension from factory) I didn't ask the insurance on that. What about the Pontiac Firebird of the same years? (70's to '81) it shares a similar setup. When I ask the insurance people how they calculate their rates they say its the area and experience of the driver but me and my friend live in the same area, he's had his license longer but has tickets. His car also costs way more. They could not give me any more info on rates they say they're just there to quote and don't know anything else. So why is this like this?

In the past when ever i've been asked by insurance companies what my car is worth i've always told them the amount that i think i could realisticly sell it for (what its worth? or so i thought) If i was to sell my car i would be able to get around 1200-1300, which is what i would say 'it's worth', HOWEVER, recently after putting my reg number into a price comparison website it automatically came up with a value of just 700. (My car has low milege, fsh and is in v good condition so is worth more than average) So my question is, if i tell them it's worth say 1250, take out their policy and then i write it off, what will they pay? Also, am i paying a higher premium than i should because i'm telling them it's true value instead of their lower valuation? and if so, how many other people are doing this?

Its now been changed to only cover 70% rather than 80%. The copay and deductible are higher. I was a passenger in my own vehicle during a near fatal accident where the driver, who is an insured driver on my policy, had road rage with another driver. The driver ended up receiving a DUI as a result of the accident. I tried to sue my auto insurance company for under/unisured motorist, but since the accident was a sole vehicle accident, the insurance company would not settle for my injuries. Due to the nature of the accident and the result of the driver being intoxicated, the auto insurance company accepted liability for the driver's negligence and tried to settle for $4,200. I ended up hiring a lawyer because I have an unpaid hospital bill in excess of the settlement amount. In addition, I have had complications from my injuries and need lifetime treatments. We have an arbitration hearing next month, but the driver is only named on the lawsuit, not my auto insurance company. This accident happened in Pennsylvania and I had full tort, stackable, 100,000/300,000. My question is...why is the insurance company not insuring the named insured driver (who by the way happens to be my husband), on my insurance policy?

Our family has had State Farm for 70 years now, several generations, and in the last 10 years or so we have been progressively more & more disappointed in their caring and customer service. Maybe its just the 'assistants' that my local SF agent (who never talks to his clients any more) use, they both seem to have just horrible attitutudes, sarcastic, and act like you are a complete PITA every time you call. I even have an email from his main assistant that I asked her to forward to the actual agent because I was told he was the only one that could answer my question, and just today I was SHOCKED when I re-read the email, and saw in the forward of my email when his assistant sent it on to the actual SF agent, She said This guy will just not give up, he keeps haunting me about this issue! I couldn't freaking believe it. I was going to forward the email to SF headquarters in Bloomington IL, but then as I read more & more about state farm I saw they are completely independent agents in each office, and have literally NO ONE who is their boss or who can reprimand or correct them. This is unbelievable. If I treated my customers at my work place & gave them the rotten attitude treatment we get from our SF office here, I guarantee you I would lose my job. No one is in charge at state farm obviously. Back to my question - I recently bought a classic car I have been looking for a long time - getting it next week - it is 25 yrs old, all original & in perfect shape. My state (Maryland) lets me register the car as Historic if it is 20 yrs old or more. I plan to do this. I contacted my wonderful state farm office today, to get a quote on a new policy/binder for this collectors car. They apparently don't like insuring a vehicle as Historic, maybe the policy is too cheap & they do not make any money off it. The 'assistant' said the best they can do, even if I REGISTER this vehicle in Maryland as Historic & get an Historic tag, which I will do, she said the best she can do is insure it as part time, occasional pleasure use, under 7500 miles a year . Which of course is NOT an historic policy. You can get that on ANY extra car you have in your household even if it is a 2011 model !! She did say (and I understand this being required) that in order to have is classified as Antique/Classic/Historic, you have to have an appraisal done on the vehicle as if it just came off the show room floor -then the premiums would be much lower if you had full coverage on it, as historic/classic . So here we stand. Can someone out there please help me understand - am I being taken for a ride by my State Farm office? Should I shop around for insurance companies that just specialize in Classic/Historic auto insurance? If so can anyone recommend the best companies that specialize in reasonable insurance for classic/historic vehicles? Thanks for your help. .

I took out an insurance two days ago with a company called (i-kube car insurance). I've been told that I won't be able to drive between the hours of 11pm -5am and if i drive, i will have to pay 45 fine ( a GPS will be installed in my car). They took out my deposit immediately eventhough my insurance will not start till 2nd wk in February. Is it too late to cancel? I know we are legally responsible for him until he turns 18 which isn't too much longer BUT he is getting worse with everything, my husband has given up on him and just lets him come and go as he pleases and do what he wants (he claims he will kick him out on his bday but no one believes him b/c of many past threats not followed through and his kids know it so they continue to play him), I'm told to stay out of it because he isn't my son yet he is still on MY insurance and driving his mom's car while drinking and smoking pot and continuing not to follow the law with his restrictions either. I can't wait for this ungrateful punk to be out of my house. He constantly badmouths all of us with lies to everyone and blames us when things don't go his way. I was in an accident where someone side swiped me ($5.5k worth of damage). Their insurance company paid and I just got my car back (2007 Lexus IS 250 - 29k miles). I had just purchased the car 4 weeks prior to the accident from CarMax for $27k. Out of curiosity I went back to see what CarMax would give me and they offered $18k. I enrolled in Kaiser through State of California Employee Insurance program. Right after the enrollment, I cancelled the Kaiser in the middle of Febuary because my wife's employer had better deal for the familiy insurance. Kaiser sent me the insurance card. However, I have not used the Kaiser health insurance. State of California deducted my payment for the premiums. Since Feburary was the first month of the insurance coverage, and I have not seen the doctor with Kaiser, could I ask Kaiser to refund the premiums? I wasn't really looking to shop around - and wasn't planning to switch companies to save a buck or two, but I was kinda shocked when the price quote I got from Unitrin Direct (same coverage limits and deductibles) was $510 less than I'm paying now. I called and asked what the catch was and they said they sell direct with no agents/offices and pass the savings onto the customer (logical, but obviously scripted answer). They also touted an A.M. Best Excellent rating, but what good is financial stability if they bungle claims (for example) or have terrible customer service? So I guess I'm looking for a little confidence - or a big fat warning - before I jump into anything. Are they reputable? Is there any objective info available about them? Don't give me because it costs too much and they cant afford it. I think it's the price of having a car. You wouldn't get a car and say well tires are expensive, I can't afford them you just need them. This afternoon, I was at a gas station and I backed my 2003 Pontiac mini van into a concrete barrier very hard. The left rear bumper is falling off, the hatch is dented fairly bad in the corner so it is difficult to open (that dent is about 4 inches in diameter but very deep) and the side with an automatic door has two shallow dents about a foot across. One of my taillights chipped on the side but didn't crack or shatter. No broken glass or anything. The plastic bumper is cracked in a few places, and has red paint all over over it from the barrier. the doors still work (excepting that the hatch catches on the taillight area), no electronic or mechanical issues, just body damage. The question is, should I call insurance? I am almost 17 and I've had my license for about 6 months. Roughly how much would the body work cost, since my insurance with AARP is sure to go up dramatically? Or would I want to play it safe and place a claim? My parents know all about it, and it was a total accident (I missed the brake pedal and hit the accelerator). Just looking for the way that will cost me less in the long run. When you call to add the car to insurance, do you add the teenager or just add the car to your own policy? My husband and I are confused about how this works. Our twins who are turning 16 this year were given a car by a friend of ours. We want to make sure it's all done legal and legit so that if they were in an accident it would be covered. I thought you had to add the teenager to your insurance as in the person is covered not just the car. My husband thinks we can just ad the car to our policy and let them drive it and they will be covered. I don't think so, Otherwise why wouldn't everyone do that to save the money they charge when you add a teenager? Audatex is not kelly blue book they look at craigslist & not the dealer. Craigslist sometimes has cars where a mechanic might not catch it but is damaged. The price I paid is higher due to getting sick & credit went down so I had to go to a local dealer with higher interest. They want the insurance check plus $1700.00 & interest. So I will pay for this thing for over 1 1/2 years. I had it 6 days when some crazy driver almost hit me I turned & hit a wall. The insurance company says I loose my good driver discount.
